OFFICIAL RULES OF ATHLETIC BREWING COMPANY SUMMER ADVENTURE SWEEPSTAKES
- NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
- HOW TO ENTER: Beginning on [5/26/2023], at 12:00 a.m. Eastern Standard Time through [7/31/2023], at 11:59 p.m. Eastern Standard Time (“Entry Period”), there are TWO (2) ways to enter the Sweepstakes, as set forth below (each, an “Entry Method”).
Entry Method No. 1: During the Entry Period, an Entrant must visit https://athleticbrewing.com/pages/summer-adventure-sweeps. (the “Sweepstakes Website”). Complete the entry form on the Sweepstakes Website by following the on-screen instructions and providing your name, date of birth, state, email address, and mailing address.
To Earn an Additional Entry under Entry Method No. 1: During the Entry Period, an Entrant must: (i) either (a) click on the “Start Sharing” button in Sponsor’s promotional email to be connected to Sponsor’s page or (b) visit https://athleticbrewing.com/pages/summer-adventure-sweeps. (the “Invite Page”); (ii) enter the Entrant’s email address to launch the share platform; and (iii) use the share platform to invite friends and family via email, messenger, and/or Facebook (each, an “Invite”). Upon sending five (5) Invites, an Entrant will receive one (1) entry into the Athletic Brewing Company Summer Adventure Sweepstakes (the “Sweepstakes”). The Invite must be generated directly from the Share Platform on the Invite Page. Invites that occur outside of the Share Platform and Invite Page will be void.
To Earn an Additional Entry: During the Entry Period, an Entrant must make a post on any of Instagram, Facebook or Twitter with the hashtags #sweepsentry and #SummerAdventureSweeps and tag Sponsor’s official social media page in such post. Posting alone will not qualify as an Entry; use of both the above-mentioned hashtags and mention of @athleticbrewing are required. If seeking an additional Entry using this method, the Entrant’s social media account must be set to “public” in any privacy settings. Completing these steps will grant one (1) additional Entry.**
**An Entrant must be a registered user of Instagram, Facebook or Twitter in order to gain an Additional Entry via Entry Method No. 1. Creating an Instagram, Facebook or Twitter account is free. For optimal use of the Instagram, Facebook or Twitter service, a compatible mobile device is required to download the Instagram, Facebook or Twitter mobile applications. Wireless Internet access and/or other fees may apply (if accessing Instagram, Facebook or Twitter via mobile device). Consult your wireless service provider regarding your pricing plan. Not all cellular phone providers carry necessary service to use mobile device and enter the Sweepstakes. Wireless Internet access is not available in all areas.)
Entry Method No. 2: During the Entry Period, text “SUMMER” to 25708. The Entrant will then receive a text message to verify date of birth. Once verified, visit the Sweepstakes Website provided via text from 25708 and complete entry using Entry Method No. 1, as described above. Entrants will be charged for all text messages sent and received from their mobile device according to the terms in their individual calling plan with their cellular provider. All Entrants using Entry Method No. 2 must have a text messaging two-way capable mobile device and digital service in order to enter the Sweepstakes using the text messaging method. Standard text messaging fees may apply. Please consult your wireless service provider regarding your pricing plan. Not all cellular phone providers carry necessary service to participate. Check your phone capabilities for specific text messaging instructions. Text messaging service is not available in all areas.
Successful completion of Entry Method No. 1 and/or Entry Method No. 2 shall be considered an “Entry” and the person submitting the Entry, the “Entrant.” Limit of five (5) Entries per person during the Sweepstakes Period, regardless of total number of Invites. Sponsor will not verify receipt of Entries. Proof of submission of an Entry does not constitute proof of receipt by Sponsor. Released Parties (as defined below) are not responsible for entries that are late, lost, illegible, damaged, misdirected, garbled or incomplete, altered or otherwise irregular, that contain false information, that are generated by script, macro or other automated or mechanical means, that have been submitted through illicit means or by any means which subvert the entry process or that do not conform with or satisfy any or all of the conditions set out in these Official Rules. Multiple Entrants are not permitted to share the same email address for purposes of entry into the Sweepstakes. Use of any robotic, automatic, programmed, or similar method or entering more than the number of times permitted will result in disqualification of all associated Entries and of the person/account responsible for such Entries.
- ELIGIBILITY: Open to residents of the United States that are 21 years of age and older as of May 26, 2023, except for employees, agents or affiliates of Athletic Brewing Company LLC, a Connecticut limited liability company (“Sponsor”), Avid Marketing Group (“Administrator”), and each of their respective affiliates and agencies (collectively, the “Organizers”), and members of their immediate family or persons living in the same household. Void where prohibited.
- DRAWING: A random drawing will be conducted on or about August 11, 2023, by Administrator to select the winners from among all eligible Entries received. Odds of winning depend on the number of Entries received. Potential winners will be notified by email using the information provided at time of entry and must sign and return all documents required by Sponsor to verify entrant eligibility including an Affidavit of Eligibility and Release within one (1) week of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. All federal, state and local taxes resulting from acceptance of prize are the responsibility of winner. By entering the Sweepstakes, Entrant accepts and agrees to these Official Rules and the decisions of the Sponsor and the Administrator, which shall be final in all matters. All federal and state laws apply.
- LIMITATION OF LIABILITY. By entering this Sweepstakes, Entrants, on behalf of themselves and their respective heirs, successors and assigns, agree to waive any and all right to, release and discharge, and hold harmless the Organizers, Instagram, Facebook, TikTok and Twitter and their respective officers, directors, managers, employees, agents, parents, subsidiaries, affiliates, shareholders, members, successors, and assigns (collectively, the “Released Parties”), from any and all claims, actions, judgments, settlements, interests, awards, penalties, fines, losses, damages (including punitive, incidental, and consequential damages), taxes or expenses (including attorneys’ fees), and other liabilities of any kind, directly or indirectly arising out of, attributable to, or in connection with participation in this Sweepstakes (including but not limited to the awarding of any prizes or a participant’s acceptance, use, misuse, loss, or damage of or to any prize), whether arising out of the ordinary negligence of any of the Released Parties or otherwise. By entering this Sweepstakes, Entrants covenant not to make or bring any such claim against the Released Parties, and forever release and discharge the Released Parties from liability under such claims. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Organizers will not be responsible for: late, incomplete, or incorrect entries; an Entrant’s failure to receive prize notices due to Entrant’s spam, junk e-mail, or other security settings or for Entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the offer, administration of the Sweepstakes, or announcement of the prizes. If, in the Organizers’ opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel or modify, or cause the cancellation or modification of, this Sweepstakes in a manner deemed appropriate by the Organizers. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry. By entering this promotion, entrants acknowledge that the Organizers is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, TikTok or Twitter.
GRAND PRIZE: ONE (1) Grand Prize Winner will be selected to win TWO (2) Trek FX+ 2 Stagger Electric Bikes. Upon winner selection and verification, the grand prize winner will partner with Trek on Bike details (size/color, etc.) The grand prize Winner will have the option to (i) pick up the grand prize from a selected Trek store in person, in which case such Trek store will fit the bike for the grand prize Winner, or (ii) request that Sponsor ship the grand prize to a delivery location of the Winner’s choice within the United States, in which case the bikes will not be fitted for the grand prize Winner. Trek stores can be found at this link https://www.trekbikes.com/us/en_US/store-finder/ . The total approximate retail value (“ARV”) of the Grand Prize is $4,999.98.
FIRST PRIZE: TWENTY-FIVE (25) First Prize Winners will be selected to receive ONE (1) Sponsor Branded Cotapaxi Allpa 70L Duffel Bag. ARV: $160.00 per prize.
SECOND PRIZE: ONE HUNDRED (100) Second Prize Winners will receive ONE (1) pair of Sponsor Branded Goodr Sunglasses. ARV: $25.00 per prize.
Total ARV of all prizes: $11,499.98. Any difference between the approximate value and actual value of a prize (or any substitution prize) will not be awarded. All details and other restrictions of the prize(s) not specified in these Official Rules will be determined by Sponsor in its sole discretion. If a prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor’s prize obligation to a winner and no additional compensation will be awarded. Brand names and logos are for prize identification purposes only and do not indicate a partnership or affiliation of any kind.
Verification of Potential Winners: Each winner will be required to furnish valid proof of age in a form prescribed by Sponsor (for example, a copy of a valid driver’s license, birth certificate or passport) within one to two days of notification. If any prize notification is returned as undeliverable, or if a potential winner fails to return the prize claim documents within the stated time period, or if a potential prize winner cannot accept the prize as stated, or if Sponsor, in its sole discretion, deems a potential winner ineligible to receive the prize for any reason, the corresponding prize will be forfeited in its entirety and awarded (time permitting) to an alternate winner in a random drawing from among the remaining entries received. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements herein. Prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. Any and all guarantees and warranties are subject to the manufacturer’s terms and conditions, and winner agrees to look solely to such entity for any such warranty or guarantee claim. Winners are solely responsible for all federal, state, and local income taxes.
Additional Prize Restrictions:
Limit one (1) prize per person, per family, per household, and per address.
Prizes must be accepted as awarded. No prize substitution is permitted except at any time by Sponsor as determined by Sponsor in its sole discretion. Prizes are not redeemable or exchangeable for cash. Prizes are not transferable without Sponsor’s consent, which may be granted or withheld in its sole discretion and without liability of any kind.
All prizes are subject to availability. Prize eligibility and fulfillment are at the sole discretion of Sponsor.
All expenses not expressly stated in these Official Rules incurred in connection with prize acceptance and use are winner’s sole responsibility.
All taxes on any prizes are the applicable winner’s sole responsibility. Prize winners may be issued an Internal Revenue Service (IRS) 1099 Form for the value of the Prize and each winner agrees to fully cooperate with Sponsor/Administrator in conjunction with same as well as with any other governmental reporting requirements. The preceding includes the provision of his/her Social Security Number via IRS W9 Form.
Neither Sponsor nor Administrator make any representation, warranty or guarantee of any kind (including, without limitation, any warranty of merchantability, warranty of fitness for a particular purpose, warranty of title, and warranty against infringement of intellectual property rights of a third party) in connection with the Sweepstakes, whether express or implied by law, course of dealing, use or performance, usage of trade or otherwise.

- CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Connecticut, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Sweepstakes and these Official Rules shall be brought exclusively in the applicable federal or state courts located in the county of Fairfield, Connecticut.
- FORCE MAJEURE. In the event Sponsor and its agents are prevented from continuing with this Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, pandemic, epidemics, virus, quarantine, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court or other cause not within their control, Sponsor and its agents shall have the right to modify, suspend, extend or terminate the Sweepstakes, and award or not award the Prize, in its sole discretion.

7. PRIVACY. All Entrant information will be shared by Sponsor with Athletic Brewing Company LLC to be used for, among other purposes, providing Entrants with marketing materials. Information submitted with an entry is subject to the Athletic Brewing Company LLC Privacy Policies. 8.
