Athletic Brewing Company LLC (“Company,” “us,” “our,” or “we”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (this “Privacy Policy”).

This Privacy Policy describes how your personal information is collected, maintained, protected, used, and shared when you visit or make a purchase from this website, our other websites, other Company properties and online experiences, including apps, that link to this Privacy Policy (collectively, our “Sites”).

This Privacy Policy applies to information that we collect on our Sites and in email, text, other electronic messages between you and our Sites, and through our mobile and desktop applications, which provide dedicated non-browser-based interaction between you and our Sites. It does not apply to information collected by:

  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on our Sites.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Sites, including information:

Information You Provide to Us 

The Information we collect on or through our Sites may include:

  • Information that you provide by filling in forms on our Sites. This includes Information provided at the time of registering to use any of our Sites, subscribing through any of our Sites, posting reviews of our products, or requesting further services. We may also ask you for Information when you enter a contest or promotion sponsored by us, and when you report a problem with any of our Sites.

Information We Collect Through Automatic Collection Technologies

DO NOT TRACK

Except to the extent we are required by applicable law to honor certain opt-out preference signals, we do not alter our Sites’ data collection and use practices when we see a Do Not Track (DNT) from your browser, which means that we do not honor DNT signals.

 

HOW DO WE USE YOUR INFORMATION?

We use Information that we collect about you, or that you provide to us, including any Personal Information:

SHARING YOUR PERSONAL INFORMATION

We may disclose aggregated information about our users, and Information that does not identify any individual, without restriction.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the Information you provide to us. We have created mechanisms to provide you with the following control over your Information:

If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.
  • Targeted Advertising. You may opt out of receiving targeted ads from certain data and advertising partners that participate in certain industry self-regulatory programs. The Digital Advertising Alliance (DAA) provides a website at www.aboutads.info/consumers with information about how to opt out of targeted advertising from some or all of the DAA’s participating companies. YOUR STATE PRIVACY RIGHTS

General information regarding our collection, use, and disclosure of personal information is set forth in the Privacy Policy above. 

In the past 12 months, we have collected categories of personal information described in the section of the Privacy Policy above titled Personal Information We Collect, and we have collected this information from the sources described in the section titled We Collect This Information. Depending on your level of interaction with us, we may not have collected your personal information from all of the categories listed in the Privacy Policy above. We collect and use your personal information for the business or commercial purposes described in the section titled How Do We Use Your Information, and retain it pursuant to the section titled Data Retention And Security.

We disclose the following categories of personal information for business or commercial purposes to the categories of recipients listed below:

  • Inferences drawn from collected information – We may disclose this information to service providers who perform business services for us; and third parties, such as advertising networks, analytics and social media networks.

We do not collect any sensitive personal information from you within the scope of State Privacy Laws.

Rights to Your Information

In addition to the rights set forth in our Privacy Policy, State Privacy Laws may, depending on your state of residence, provide you with the following rights:

  • Right to know. You may have the right to know whether we process your personal data and to access such personal data. You may also have the right to request that we disclose certain information to you about our collection, use, or disclosure of your personal information.
  • Right to data portability. You may have the right to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business without hindrance, where the processing is carried out by automated means.
  • Right to delete. You may have the right to delete personal data that you have provided by or that we have obtained about you. Please note that we may deny such request if the requested deletion falls under an exception as set forth in the State Privacy Laws.
  • Right to correct. You may have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which we process it.
  • Right to opt out. You have the right to opt out of the processing of your personal data for purposes of: (i) targeted advertising; (ii) the sale of personal data; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. As of the latest date of the Privacy Policy:
    • We DO process personal data and share it with third parties for the purposes of targeted advertising, which also constitutes the “sale” of personal data under State Privacy Laws;

To our knowledge, we do not sell or share the personal information of minors under 16 years of age.

After submitting a request, we will take steps to verify your identity in order for us to properly respond and confirm that it is not a fraudulent request. In order to verify your identity, we will ask, at a minimum, that you provide your name, email address, and relationship to us, so that we can seek to match this information with the information existing in our systems. When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected personal information, we may contact you for more information, or we may not be able to meet your request.

Only you or an agent legally authorized to act on your behalf may make a verifiable request related to your personal information. If you are making a request as the authorized agent of a California consumer, we will ask you also submit reliable proof that you have been authorized in writing by the consumer to act on such consumer’s behalf. If you are making a request as the parent or legal guardian of a known child regarding the processing of that child’s personal data, we may ask you to submit reliable proof of your identity.

Response Time; Your Right to Appeal

We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, State Privacy Laws allow us up to 90 days to respond. We will contact you within 45 days from when you contacted us to inform you of the need for additional time and the reason for such extension. We may charge you a reasonable fee to cover administrative costs if your requests are manifestly unfounded, excessive, or repetitive.

If we decline to take action on a request that you have submitted, we will inform you of our reasons for doing so, and provide instructions for how to appeal the decision. Depending on your state of residence you may have the right to appeal within a reasonable period of time after you have received our decision. If you have this appeal right, within 60 days (45 days for residents of Colorado) of our receipt of your appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, we will provide you with a method for contacting your state attorney general’s office to submit a complaint.

California “Shine the Light”

In addition to the above rights, under California Civil Code Section 1798.83 (“Shine the Light”), California residents may have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of the categories of personal information, as defined under Shine the Light, such as name, email address, and mailing address, and the type of services provided to the customer that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties. Notice of Financial Incentive

We may offer you financial incentives, including discounts, coupons, gift cards, or other rewards, for sharing personal information through programs that we may provide from time to time (collectively, our “Programs”). For example, we may “offer you free products or discount codes for your participation in surveys or sweepstakes, for making reviews on our products, as part of invitations to events, or in relation to other offers”). When we offer our Programs to you, we believe that the value of the different pricing or services you receive exceeds the cost of providing your personal information. Your participation in these Programs is completely optional and subject to the terms provided to you at the time you sign up.

 

DATA RETENTION AND SECURITY 

When you place an order through any of our Sites, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We have implemented measures designed to secure your Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All Information you provide to us is stored on our secure servers behind firewalls.

LIMITATIONS 

Age Restrictions 

None of our Sites are directed to or intended for persons under 21 years of age. We do not knowingly collect Personal Information from persons under 21. If you are under 21, do not use or provide any Information on any of our Sites or through any of their features, register on any of our Sites, make any purchases through any of our Sites, use any of the interactive or public comment features of any of our Sites, or provide any Information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a person under 21, we will delete that information. Geographic Restrictions

We are based in the State of Connecticut in the United States. We provide our Sites for use only by persons located in the United States. We make no claims that any of our Sites or any of the content on any of our Sites is accessible or appropriate outside of the United States. Access to our Sites may not be legal by certain persons or in certain countries. If you access any of our Sites from outside the United States, you do so on your own initiative and risk and are responsible for compliance with local laws.
