Event Terms

By acceptance and/or use of a ticket, or any electronic form thereof, (collectively, the “Ticket”) for the event (“Event”) at the Athletic Brewing Company LLC facility, located at 75 Cascade Boulevard, Milford, Connecticut 06460 (the “Facility”), the Ticket holder (“Holder”), on behalf of (i) himself/herself, (ii) any minor(s) accompanying Holder, and/or (iii) any other accompanying party for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the Ticket terms) (collectively with any accompanying minor an “Accompanying Party”), agrees to the following terms:

 

This Ticket is a limited, revocable license to attend the Event listed on the Ticket. The revocable license granted by the Ticket will be terminated, and ejection, detention or arrest may result for violating any law or any Facility policy or Event policy, including, entering unauthorized locations within the Facility, offensive language or disruptive behavior. Holder consents to security searches and/or screening and waives all related claims. Holder and any Accompanying Party consent to and waive compensation for use of their photographs, images, likeness, videos or other personality rights in connection with the Event or any other promotions and activities before, during or after the Event (“Event Activities”). All Events and Event Activities are subject to modification or cancellation without refund.

 

WARNING: Holder acknowledges and assumes all risks and dangers associated with the Event or any Event Activities, acknowledges that attendance is voluntary, and agrees that Athletic Brewing Company LLC, and all related entities and affiliates, together with its and their respective shareholders, members, officers, managers, directors, employees, contractors, agents, licensees, licensors, promotors, organizers, media partners, sponsors, and vendors, and any other person or entity that in some manner is responsible for sponsoring, producing, directing, teaching, running or supervising the Event, or that owns, controls, leases or maintains the Facility (collectively, the “Released Parties”), will not be responsible for any personal injury (including death), illness, property damage, theft, or any other loss suffered in connection with the Event or Event Activities, the negligence of any of the Released Parties, the actions of other Event attendees, or any other circumstances or causes of any kind or nature. By attending the Event or Event Activities, Holder is deemed to have given a full release of liability to, and forever discharges, the Released Parties, to the fullest extent permitted by law, from any claims that Holder, and/or any Accompanying Party, has or may have for causes of action arising out of attendance at, observation of and/or participation in the Event or Event Activities. If Holder does not wish to, or is not authorized to, grant such rights, releases and waivers on behalf of an Accompanying Party, Holder should immediately leave the Facility with each Accompanying Party.

 

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON HIS/HER BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTY, AGREES TO ASSUME ALL RISKS ASSOCIATED WITH ANY COMMUNICABLE DISEASE AND COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE RELEASED PARTIES. THIS TICKET IS NOT FOR RESALE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.

 

All matters arising out of or relating hereto, are governed by, and construed in accordance with, the laws of the State of Connecticut, without giving effect to any conflict of laws provisions thereof. Any legal suit, action, or proceeding arising out of or relating to the Ticket or the Event will be instituted exclusively in the federal or state courts in each case located in Fairfield County, Connecticut, and Holder irrevocably submits to the exclusive jurisdiction of such courts in any legal suit, action, or proceeding.
