Ambassador Acceptable Use Policy
Welcome to the Athletic Brewing Company LLC (“Athletic Brewing”) Ambassador Team! We are stoked to have you join us. Our community is a positive place to connect, learn, share, and raise a glass for cheers together. Since our ambassador team was founded in 2019, with a few select athletes and adventurers, this incredible team has grown into something truly special.
This is a space to celebrate our achievements, triumphs, accomplishments and accolades. It’s also a safe space to be ourselves and be celebrated for who we are as individuals, but for this to happen, we need help from you!
The Basics
Any use of the Athletic Brewing Ambassador community forum (“Community Forum”) not explicitly permitted by Athletic Brewing is prohibited. If you use the Community Forum on behalf of others you agree that you will obtain their authorization prior to acting on their behalf, will inform them about the terms that apply to the Community Forum and ensure they agree to such terms. You are responsible for keeping your account secure and letting us know about any unauthorized use of your account.
You acknowledge that beta features and/or trial services may be untested, non-functional, and/or partly functional features of the Community Forum. If you elect to use a beta feature and/or trial service, you do so at your own risk. Once you use a beta feature, you may be unable to revert back to a prior non-beta version of the same or similar feature. Additionally, if such reversion is possible, you may not be able to return or restore data created within the feature back to the prior non-beta version. Athletic Brewing does not make any warranties or representations with respect to such beta features and/or trial services and does not warrant that the beta features and/or trial services will be provided with due care. Do not rely on the beta features and/or trial services for any purpose whatsoever. Beta features and/or trial services may harm and/or interrupt the regular running of your software and/or hardware. Without limiting the foregoing, beta features and/or trial services will be considered part of the Community Forum and all provisions of this Acceptable Use Policy relating to the Community Forum will apply to the beta features and/or trial services.
You acknowledge that your use of the Community Platform is subject to Athletic Brewing’s privacy policy and any other terms and conditions applicable to Athletic Brewing.
By accessing or using any part of the Community Forum, you accept and ensure that your agents, heirs, successors, permitted assigns, and other affiliates, without limitation or qualification, accept these terms and conditions. If you do not agree with all of these terms and conditions, you may not use any portion of the Community Forum. For the avoidance of doubt, by accessing or using the Community Forum, you agree to form a binding contract with Athletic Brewing.
Community Guidelines

- Give more than you take from this group. Self-promotion, spam, and irrelevant links aren’t allowed

- If you aren’t sure if a comment or other communication violates this policy, consider editing it or not posting it at all
- Be mindful of what you say both inside and outside of this group. As an ambassador of Athletic Brewing, you are expected to reflect Athletic Brewing’s values at all times. Any inappropriate comments or actions shall be considered grounds for removal
- Keep posts positive

Remember access to the Community Forum is a privilege, not a right. We look to our ambassadors to create and maintain a safe space.
Community Forum Communications
As part of your participation in the Community Forum, you have the opportunity to provide content, comments, posts, testimonials and other materials (including any photographs, text, graphics, images, audio, video, location information, tags, hashtags, references, personally identifiable information, comments and other materials and information associated therewith, collectively, “User Content”). We reserve the right to remove your User Content at our discretion, without notice and without liability. By using the Community Forum you represent and warrant to Athletic Brewing that:
- You are at least twenty-one (21) years of age;
- You have full power and authority to agree to this Acceptable Use Policy;
- The User Content is your own original creation, you did not take (in whole or in part) the User Content from another website, social media post, or elsewhere;
- You own all rights in and to your User Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to such User Content;
- The User Content does not contain any trademarks, logos, brand names, advertising, sponsorship, or promotional material owned by any person or entity, other than you or Athletic Brewing;
- The User Content does not contain anything illegal, defamatory, obscene, threatening, or racially, sexually, religiously, or otherwise objectionable and offensive;
- You have not impersonated, and will not impersonate, anybody;
- You have permission from any person(s) (or in the case of minors, their legal guardian), appearing in the User Content to provide us with the rights in and to the User Content as described in this Acceptable Use Policy;
- Your upload or post of the User Content, and our use of the User Content (as described in this Acceptable Use Policy), does not and will not violate any applicable laws or the terms or requirements of any applicable platform(s);
- Our use of your User Content (as described in this Acceptable Use Policy) will not violate the rights, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, moral, proprietary or other rights, of any third party;
- You confirm and agree that our use of your User Content (as described in this Acceptable Use Policy) does not and shall not require any payment to any person or entity and does not require license, authorization, approval or consent by any other person or entity; and
- You have read, and you agree to comply with, all of the terms and conditions in this Acceptable Use Policy.
Rights in the User Content
You hereby grant Athletic Brewing and its affiliates and its and their respective agents, licensees, sublicensees, contractors, successors and assigns (collectively, “Licensees”) an unlimited, worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, sublicensable, perpetual, transferable right and license to host, publish, display, perform, reproduce, copy, distribute, transmit, communicate, alter, modify, reformat, translate, create derivative works of, or otherwise use your User Content to market, operate, improve, develop, and promote the Community Forum and in all forms of advertisement, marketing, promotion, production, distribution and sale of Athletic Brewing products and services throughout the World in any and all formats and media whether now or hereafter known or devised and by any and all technologies and means of delivery whether now or hereafter known or devised.
You hereby irrevocably and unconditionally: (a) grant each of the Licensees the right, in the Licensees’ sole discretion, to use your name, social handle, username, image, likeness, caption, location and other identifying information in connection with the User Content; (b) grant each of the Licensees any and all consents and permissions of any person or entity as required by any applicable laws, including, without limitation, any copyright and related laws (and all other laws now or in future in force in any part of the World) that may be required for the Licensees’ use of the User Content and the rights that you are granting under this Acceptable Use Policy; (c) waive (and agree not to enforce) any and all rights in the User Content, including, without limitation, any moral rights or equivalent rights that you may otherwise have under any laws now existing or which come into effect in any part of the World.
You acknowledge and agree that the Licensees have no obligation to use your User Content or your identifying information and the Licensees may remove or stop using any User Content and identifying information at any time for any reason or no reason. Any Licensees’ use of any User Content does not imply any endorsement or affiliation between you and such Licensee. If requested by us, you shall execute and deliver all documents, provide all information, and take or refrain from taking such actions, as may be necessary or appropriate to achieve the purposes of this Acceptable Use Policy.
You acknowledge and agree that we do not have any control over, and are not responsible or liable for, any act of any third-party, including, without limitation, a third-party’s re-posts or other republication of the User Content. You, on behalf of yourself and your heirs, successors and permitted assigns, as applicable, hereby forever releases, waives, discharges, absolves, and covenants not to sue, each of the Licensees, with respect to any and all losses, injuries, deaths, damages, liabilities, claims, deficiencies, actions, judgments, interests, awards, penalties, fines, costs or expenses, including, without limitation, attorney and professional fees and costs, and the cost of enforcing any right to indemnification hereunder (“Losses”) arising out of or resulting from the use of, in accordance with this Acceptable Use Policy, any of the User Content, which you or your heirs, agents, successors, affiliates, and permitted assigns, had, now have, or hereafter may have, by reason of any matter connected in any way with the Licensees’ exercise of their respective express or implied rights under this Acceptable Use Policy. You shall indemnify, defend and hold each of the Licensees harmless from and against any and all Losses incurred by any of the Licensees arising out of, resulting from, or in connection with any breach of your representations, warranties, covenants and obligations under this Acceptable Use Policy. Athletic Brewing reserves the right to alter, modify, amend or replace this Acceptable Use Policy without notice.
If we determine that you have violated this Acceptable Use Policy, we reserve the right to suspend or terminate your account at any time and/or remove/delete any of your User Content, without prior notice and without liability. In addition, we reserve the right to take any other action, including any rights or remedies afforded to us at law or in equity.
